Privacy policy

1. Declaration

The privacy of your personal data is very important to us. The purpose of this document is to inform you about the processing of your personal data when you are using the Website.

You should be aware that in order to create an account on the Website, the fields marked with “*” are mandatory fields, as we need this information to identify you. 

If you log-in to the Website using a social media account (e.g. Facebook etc.), we will collect your profile data. 

We process your personal data in order to send you direct marketing material by email or SMS or WhatsApp when you choose this option. You can opt out of receiving future marketing communications at any time.

We process your personal data if you have registered your participation in various campaigns organised by the Company.

When you order or purchase products and/or services from the Website or using the Company’s e-mail address, we collect the personal data we need from you in order to provide you with the service. This information is generally name, surname, e-mail address, telephone number, products ordered, delivery address, bank details. 

Also, when you return products or cancel your order, we collect your personal data necessary for the Company to process the return or to process the cancellation. This information is generally your name, surname, e-mail address, telephone number, products ordered and returned, bank details for the refund.

3. How we use the personal data

Your personal data will be collected and managed by the Company for the following purposes:

  • to best customise content and resources according to your preferences;
  • to develop and improve the Website and its systems to serve you better;
  • to improve the Company’s services;

We do not make automated decisions solely on the basis of automated processing, including profiling, which produces legal effects in relation to you or which significantly affects you in a similar way.

The retention periods of your personal data depend on the purpose for which they are processed. The criterion used to determine the applicable retention period is the fact that we will retain the personal data set out in this Policy for as long as (i) it is necessary for the purpose in question, (ii) it is necessary for the performance of our contractual or other relationship with you, (iii) you have consented to it, and/or (iv) it is required by applicable laws on the retention of personal data.

4. Your obligations when registering for an account

If you create, use or hold an account on the Website, you agree:

i) to provide true, accurate, current and complete data and information about yourself as prompted by the account registration form; and

ii) to maintain and promptly update your registration data to be true, accurate, current and complete. 

If you provide any information that is untrue, inaccurate, incomplete or not current, the Company has the right to suspend or cancel your account and refuse any present or future use of its services by you.

5. Account and password privacy

You are responsible for maintaining theconfidentiality of your account and password and are fully responsible for all activities that occur under your account or with yourpassword .

You agree to notify the Company immediately of any unauthorised use of your password or account and to ensure that youlogout of youraccount at the end of each session. TheCompany cannot and will not be liable for any loss or damage resulting from yournon-compliance  with this section.

TheCompany reserves theright, in its sole discretion, to block your password, the use of its services , to remove any material posted on the Site, with or without cause. The Company may alsosuspend theprovision of its service , in whole or in part, with or without notice.

You agree that theCompany may immediately terminate youraccount , in certain circumstances and without priornotice , by discontinuing all access to the Service. Further, you agree that any termination or blocking of your account is at the  Company’ ssole discretion  and that it will not be liable to you or  any third party for any termination of your account or  access to the Service. 

6. Deleting your account at your request

If you wish to delete your account, you can either send us an e-mail at contact@caelesteparfums.com requesting us to do so, or you can do so directly from your account on the Website (if you have this option). 

Deleting your account from the Website will result in the deletion of all your personal data on the Website. 

7. Forms

In order to contact us or to access various services (purchase products, return products, etc.), you may be asked to fill in certain forms as presented on the Website. For the provision of the service in question, the information specified as mandatory in the respective forms is required; in their absence, the service cannot be provided. 

8. Order and delivery of goods and services

In order to benefit from the services offered by the Company, you will have to provide certain personal data. Your refusal to provide this data will make it impossible to use the Company’s services and to fulfil the commercial relations and the purchase contract. 

9. Marketing communications and participation in promotional campaigns

We will only send you marketing communications by email and/or SMS and/or WhatsApp if you have consented to this.

To do this, we provide you with a tick box, and if you agree to receive marketing communications, you need to tick the box. If you have opted-in to marketing communications, you may opt-out of receiving any future marketing communications at any time, please contact us at contact@caelesteparfums.com, providing us with your first and last name, e-mail address or telephone number (depending on the means of contact you have indicated for the marketing communications) and indicating that you wish to opt-out of marketing communications.

You can also opt-out of receiving future marketing communications by selecting the “Unsubscribe” box in the footer of each marketing communication.

Participation in promotional campaigns

In case you wish to participate in various promotional campaigns, for which certain personal data is required, the processing of your personal data will be carried out with your consent. You can opt-out of a particular promotional campaign at any time by contacting us at contact@caelesteparfums.com, and providing us with your details so that we can identify and record your withdrawal of consent. 

10. Information from traffic monitoring reports

When you visit the Website you disclose certain information about yourself, such as your IP address, the time of your visit, the location from which you accessed the Website, device information (such as hardware model, operating system version, browser used, etc). Gloria Diamond, like other operators, records this information in order to improve the user experience and the quality of services offered.

11. Personal data recipients 

We inform you that we disclose your personal data to third parties, but only in the situations and under the conditions set out below. The personal data recipients are:

  • suppliers that perform services related to the Website (e.g. hosting and/or maintaining and/or developing the Website and its content, etc.). These providers are located in Romania or in the European Economic Area and have access only to your personal data required to fulfil their contracted services. These recipients will honour contractual confidentiality obligations.
  • contractual partners to provide courier and bank payment services.
  • government authorities to fulfil our legal obligations.

We also inform you that your personal data are stored on servers located on the territory of the European Economic Area Member States.

We are committed to ensuring that where we collect personal data online, the information is secure. In order to prevent unauthorised access or disclosure, we have put in place appropriate procedures to safeguard and secure the information we collect online. However, while we will do our best to protect your personal data, you should be aware that the transmission of information over the Internet is not completely secure and that we cannot guarantee the security of your personal data transmitted to the Website or any third party. 

14. Your personal data rights

Under the data processing and data protection legislation in force, you have the following rights:

  • The right to access and obtain a copy of your personal data: You have the right to request confirmation whether we process any of your personal data. Where applicable, you may have access to your personal data and to certain information about how it is processed. In some cases, you may ask us to provide you with a copy of your personal data that we process.

For those situations where, by law, the Company determines that your request to delete your personal data must be complied with, the Company will carry out the deletion.

Withdrawal of consent will not affect the lawfulness of any processing carried out on the basis of consent given prior to the receipt of that withdrawal.

You may exercise these rights by sending a written request to the Company, in electronic format, to the following e-mail address contact@caelesteparfums.comwith the mention Data Protection.  The Company will respond to your request as soon as possible, but no later than 1 (one) month after receipt. This period may be extended by 2 (two) months when necessary, taking into account the complexity and number of applications. 

The Company, according to the applicable legislation, offers, free of charge, access to and/or the possibility to obtain copies of the personal data only for the first 3 (three) requests of the same type relating to the same information, otherwise access to and/or obtaining of copies will be made against a cost, which the Company evaluates at 50 Euro, equivalent in RON at the BNR exchange rate on the day of payment / request, this amount may be updated.

You also have the right to lodge a complaint with the competent supervisory authority, namely the National Supervisory Authority for Personal Data Processing (www.dataprotection.ro ). 

15. Amendments to this policy

The Company may amend this Privacy policy from time to time to reflect our current privacy practices. When we make changes to this policy, we will revise the update date at the beginning of this document.
